End User License Agreement

K&T hereby grants you a non-exclusive licence to use its accompanying K&T font software product on the following terms:
1. K&T font software is sold subject to a licence for it to be used on (5) computers and one (1) printer. This licence allows K&T font software to be used on five different computers and one printer on one (1) site within a single company or organization. K&T font software is also sold subject to a multiple computer and multiple printer licenses. These licenses allow K&T font software to be used on a specific number of computers and a specific number of printers on one (1) site within a single company or organization.
2. Companies and organizations can apply to K&T to purchase a multi-user licence if they would like to use a K&T font on more computers or printers than the original licence agreement allows, but applications for an additional licence must be made in writing or by E-mail within fourteen (14) days of any breaches of the original licence agreement.
3. Individuals, companies, and organizations which break a licence agreement by: using K&T font software on more computers, printers or sites than the licence agreement allows, copying K&T font software for yourself (except for back-up purposes), copying K&T font software for other users who do not have a licence agreement, or using K&T font software without a licence agreement, will be subject to legal action by K&T.
4. Individuals, companies, or organizations must not copy, modify, convert, translate, reverse engineer, decompile, disassemble, or create derivative works based on any K&T font software.
5. An End User License Agreement (EULA) for the K&T font software will be sent by mail to the purchaser. Individuals, companies and organizations must be able to provide proof of a End User License agreement for all K&T font software used by: themselves, their company or their organization, if asked for by K&T.
6. Title, ownership rights, and intellectual property rights belong to K&T. Copyright and intellectual property laws such as the Copyright, Design and Patents Act 1988 and Copyright regulations 1992 protect the K&T font software. Purchasing K&T font software does not entitle the purchaser to ownership of a font, when purchasing K&T font software the purchaser is paying for the licence to use and output the font on a specific number of computers and printers.
7. K&T warrants that for a period of ninety (90) days from the date of acquisition, the K&T font software if operated as directed, will substantially achieve functionality as described in K&T installation information. K&T does not warrant, however, that your use of the K&T font software will be uninterrupted or that the operation of K&T font software will be error-free.
K&T also warrants that the media containing the K&T font software is free from defects in material and workmanship and will remain so for ninety (90) days from the date you acquired the K&T font software. K&T's sole liability for any breach of this warranty shall be, in K&T's sole discretion: (1) to replace defective media; or (2) to advise you how to achieve substantially the same functionality with the K&T font software as described in K&T installation information; or (3) if the above remedies are impractical, to refund the license fee paid for the K&T font software.
Repaired, corrected, or replaced K&T font software shall be covered by this limited warranty for the period remaining under the warranty that covered the original K&T font software, or if longer, for thirty (30) days after the date (a) of shipment to you of the repaired or replaced K&T font software, or (b) K&T advised you how to achieve the functionality described in this website.
8. Only if the purchaser informs K&T about a problem with their K&T font software during the applicable warranty period and provides evidence of the date a license for the K&T font software was purchased will K&T be obligated to honour this warranty. K&T will use reasonable commercial efforts to repair, replace, advise or, for individuals, refund the license fee paid for the K&T font software within thirty (30) days of being notified.
9. If individuals, companies and organizations copy, modify convert, translate, reverse engineer, decompile, create derivatives, or disassemble K&T font software during the warranty period; if the media is subject to accident, abuse, or improper use; or if the terms of this agreement violated, the warranty shall immediately be terminated. This warranty shall not apply if the K&T font software is used on or in conjunction with hardware or software with which it was not designed to be used.
10. This is a limited warranty and it is the only warranty made by K&T. K&T makes no other warranties, express or implied, including but not limited to warranties of merchant ability, fitness for a particular purpose and non-infringement of third parties' rights.
You may have other statutory rights. However, to the full extent permitted by law, the duration of statutorily required warranties, if any, shall be limited to the above limited warranty period. In no event will warranties provided by law, if any, apply unless they are required to apply by legislation notwithstanding their exclusion by a contract. No persons other than a director of K&T are authorized to make any modifications, extensions, or additions to this warranty.
11. Under no circumstances and under no legal theory, tort, contract, or otherwise, shall K&T be liable to any individual, company or organization for any indirect, special, incidental, or consequential damages of any character including, without limitation, damages for loss of goodwill, work stoppage, computer failure or malfunction, or any other commercial damages or losses.
In no event will K&T be liable for any damages in excess of the amount K&T received from the purchaser for a license for the K&T font software, even if any other party has informed K&T of the possibility of such damages, or for any claim. This limitation of liability does not apply to liability for death or personal injury resulting from K&T's negligence to the extent that applicable law prohibits such limitation. Some legislation does not allow the exclusion or limitation of incidental or consequential damages, so this exclusion and limitation may not apply to you.
