THE MYFONTS FONTACULAR 2023 SWEEPSTAKES

OFFICIAL RULES

 

These are the official rules that govern how the MyFonts Fontacular Sweepstakes (the “Contest”) will operate. In these rules, “we,” “our,” and “us”, “MyFonts” and “Monotype” refer to Monotype Imaging Inc., the sponsor of the Contest. “You,” “yourself,” “I,” “me,” and “my” refers to an eligible Contest entrant.

 

CHECK WITH YOUR EMPLOYER: It is your sole responsibility to review and understand your employer’s policies regarding your eligibility to participate in contents of this sort. If you are participating in violation of your employer’s policies, you may be disqualified from entering or receiving prizes. If you are a government employee, you are responsible for understanding the government gift and ethics rules that are applicable to you and you may not be eligible for the Contest.  We disclaim any and all liability or responsibility for disputes arising between an employee and their employer related to this matter, and prizes will only be awarded in compliance with the employer’s policies.

 

1. CONTEST DESCRIPTION

The Contest is run by Monotype.  This Contest is Fontacular 2023. The Contest is voluntary and does not require you to purchase anything from the Contest sponsor.

 

THE CONTEST IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW and is subject to applicable international, federal, state and local laws and regulations.

 

2. WHAT ARE THE START AND END DATES?

The Contest starts at 12 a.m. Eastern Daylight Time (“EDT”) on October 16, 2023, and ends at 11:59 p.m. EDT on October, 20, 2023 (the “Entry Period”). Entries must be made within the Entry Period to be eligible.

 

3. WHO CAN ENTER?

To be eligible to win prizes in this Contest, when you make your Entry, you must be:

  • 18 years of age or older;
  • NOT a resident of any of the following countries: Cuba, Iran, North Korea, Sudan, and Syria, Russia (as U.S. export regulations prohibit the export of goods and services to these countries);
  • You are NOT an employee of Monotype Imaging Inc., or any of its affiliated companies worldwide; and
  • You are NOT an immediate family member (parent, sibling, spouse, or child) or household member of any person identified in the prior bullet point.

 

4. WHAT CONSTITUTES AN ELIGIBLE ENTRY

To be eligible for consideration an Entry must:

  • Purchase any Monotype Fonts Subscription plan

 

  • To obtain an entry without making a purchase, legibly handprint your name, street address, city, state or province, zip or postal code, country, telephone number, and complete e-mail address on a standard 4” x 6” postcard (with no outer envelope) and mail to

5. HOW TO SUBMIT YOUR ENTRY

4.1 For cash prizes:

Purchasing on of our Monotype Fonts Subscriptions: https://www.monotypefonts.com/pages/plans. NOTE: This gives you automatic entry but NO PURCHASE NECESSARY.

4.2 For non-cash prizes:

- Tweet @myfonts with what you’re most excited about with the subscription and use hashtag #myfonts5kgiveaway or

- Like and Comment on the main MyFonts Instagram or Facebook 5k Giveaway Post or

- Share any MyFonts Instagram 5k Giveaway Post to your Instagram story or

- Retweet any MyFonts Tweets about the Giveaway or

- Tag a friend in the any MyFonts Instagram or Facebook 5k Giveaway Post

Multiple entries for non-cash prizes are welcome and increase your chances of being drawn in the lottery. Participants who have purchased our Monotype Fonts Subscription are automatically entered into the lottery for the non-cash prizes too.

 

6. HOW ENTRIES WILL BE JUDGED

A random drawing to select five (5) cash prize winners and fifty (50) t-shirt winners will be conducted on or about December 15, 2023 from among all eligible purchase and non-purchase mail entries received. The random drawing will be conducted by a Monotype Imaging Inc. employee (the “Administrator”), an ineligible participant whose decisions are final. Odds of winning a prize will depend solely on the number of eligible entries received. If there are less than 50 non-cash prize entries, all entrants will receive a prize. 

 

7. THE PRIZE

There will be 5 cash prize winners and 50 t-shirt prize winners. All winners will be chosen at random using a random generator. Any recourse to courts of law is excluded. The winners will be notified through e-mail at the end of the sweepstake using the provided email from their subscription purchase.

The prizes are as follows:

•           1 Grand Prize Winner = $3,000 cash prize and Fontacular T-Shirt

•           4 winners = $500 cash prize and Fontacular T-Shirt

•           50 winners = 2023 Fontacular T-Shirt

Cash prizes will be paid digitally by wire transfer only and will be transferred to the bank account you will be required to provide to us within 14 calendar days upon notification of your win. Non-cash prizes in kind will be sent to an address of your choice by January 2024, you will be required to provide to us within 14 calendar days upon notification of your win. If you do not provide us with a bank account to which the cash prize is to be transferred or an address to which the non-cash prize is to be sent within 14 days of the prize notification at the latest, you will forfeit your claim to the prize. For the avoidance of doubt, if you enter the sweepstakes in the name of or on behalf of your company/business/employer by listing them as the Monotype Fonts subscription customer/licensee, your company/business/employer is entitled to the prize and not you personally. It is then your responsibility and duty to ensure that the prize reaches your company/business/employer. Please note:

  • The prize will be awarded to you and you shall ensure it is used and/or distributed in accordance with your company’s policies if applicable;
  • You may not exchange your prize for cash or any other merchandise or services;
  • You may not designate someone else as the winner (if you are unable or unwilling to accept the prize, we may award it to an alternate potential winner or not at all); and
  • If you accept the prize, you will be solely responsible for all applicable taxes related to accepting the prize;
  • If a prize cannot be awarded due to circumstances beyond Monotype’s control, Monotype reserves the right to present any winner with a different prize of equal monetary value.

 

Odds of winning are affected by the number of eligible Entries received during the Entry Period. 

 

8. HOW WINNERS WILL BE NOTIFIED

If you are a winner, we will notify you by email used to purchase, by social media platform you used, or by information on the mail-in entry. If the notification that we send is returned as undeliverable, or you are otherwise unreachable for any reason, we may award the prize to an alternate winner or not at all.

 

If you are a winner, we may require you to sign an affidavit of eligibility, liability/publicity release and W-9 or W8-BEN tax form. If you do not sign and return these required forms within the time period listed on the winner notification message, we may disqualify you and we may select another Entry.  Allow two (2) weeks after notification for receipt of prize which will be sent by our method of choice.

 

9. OTHER CONDITIONS YOU ARE AGREEING TO

By entering this Contest you agree:

  • To abide by these Official Rules;
  • To the extent allowed by law, to release and hold harmless Monotype Imaging Inc., Instagram, and their respective parents, subsidiaries, affiliates, directors, employees and agents, from any and all liability or any injury, loss or damage of any kind arising from or in connection with this Contest, your participation in this Contest or any prize won;
  • That the decisions of Monotype will be final and binding on all matters related to this Contest; and
  • This Contest will be governed by the laws of the Commonwealth of Massachusetts, and you consent to the exclusive jurisdiction and venue of the Massachusetts courts (state and federal) located in Boston, Massachusetts, USA for any disputes arising out of this Contest.

 

10. CONTEST SPONSOR

11. YOUR PRIVACY

Monotype Imaging Inc.’s Privacy Policy will apply to this Contest, to any information you submit to us, and to any and all information that we receive from you if you are chosen as a prize winner. The Privacy Policy is available at http://www.monotype.com/legal/privacy-policy.
